3.3 No person shall occupy the Affordable Dwellings unless that person:-
3.3.1) was a person in Housing Need and satisfied the Local Requirement at the time of his or her first Occupation of the Affordable Dwelling; or
3.3.2) is a member of a household of and living with a person in Housing Need who satisfied the Local Requirement at the time of his or her first Occupation of the Affordable Dwelling; and (in either case)
3.3.3) Occupies the Affordable Dwelling as his or her sole or main residence.
But nothing in this clause shall require any person who satisfied such requirements when they first occupied an Affordable Dwelling to vacate the Affordable Dwelling if they cease to qualify under paragraph 3.3.2 by virtue of death, hospitalisation, or breakdown of a relationship with a person who qualified under paragraph 3.3.1.
3.4 If no person in Housing Need and meeting the Local Requirement is identified or wishes to purchase the Affordable Dwelling within a period of 4 weeks from the date that the Affordable Dwelling becomes available for occupation, the Affordable Dwelling may be offered to a person in Housing Need and meeting the Local Requirement relating to any directly adjacent parish to the Parish. If, following a further period of 4 weeks, no person is identified or wishes to purchase the Affordable Dwelling, a person from any parish in Housing Need and meeting the Local Requirement within the District of Torridge may purchase the Affordable Dwelling and should there still be no person identified or wishing to purchase the Affordable Dwelling after a further period of 4 weeks a person in Housing Need with a Local Connection to any parish within the former North Cornwall District, North Devon, West Devon, or Mid Devon may purchase the Affordable Dwelling. PROVIDED THAT during the said periods the Affordable Dwelling shall have been continually marketed within the Parish or District, as appropriate, at a price not exceeding the Restricted Price.
3.5 Where the Owner of an Affordable Dwelling is an Registered Provider the Affordable Dwelling may also be occupied in accordance with any nomination and management agreement in effect between the Council and that Registered Provider.
LOCATION
The self-contained village of Bridgerule lies on the Devon/Cornwall border and supports a useful range of local village amenities including places of worship, primary school, village store, garage and popular local inn, etc. The popular coastal town of Bude is some 6 miles and lies on the rugged North Cornish coastline famed for its many areas of outstanding natural beauty and popular bathing beaches.
